1. About these terms

These terms and conditions apply to your use of the Oak Living website at www.oakliving.com.au (the website). By accessing or using the website, you agree to these terms. If you don't agree, please don't use the website.

These terms cover the website only. Any design or building work we carry out for you will be governed by a separate written building contract.

2. Who we are

In these terms, "Oak Living", "we", "us" and "our" means Oak Living Pty Ltd (ABN 69 617 553 876). "You" and "your" means anyone who accesses or uses the website.

Oak Living is a registered building practitioner in Victoria (registration CDB-U 59242). Our office is at 31A Nepean Hwy, Seaford VIC 3198.

3. Using the website

You may use the website for personal, non-commercial purposes, such as exploring our homes and services or getting in touch with us. When using the website, you must not:

• use it in a way that breaks any law or infringes the rights of another person
• copy, scrape or harvest content or data from it, by automated means or otherwise, without our written consent
• interfere with its operation, security or availability, or introduce viruses or other harmful code
• try to gain unauthorised access to the website, its servers or any connected system
• submit false, misleading or offensive information through any form

We may suspend or restrict access to all or part of the website at any time without notice, for example for maintenance or updates.

4. Information on the website

The information on the website is general in nature. It doesn't take into account your personal circumstances, your land or your budget, and it isn't financial, legal, planning or building advice.

We take care to keep the website accurate and current, but we don't guarantee that all content is complete, correct or up to date. Before relying on anything you read here, please speak with our team and get independent advice where appropriate.

Nothing on the website is an offer to build or forms part of any contract unless we expressly agree to it in writing.

5. Home designs, images, pricing and inclusions

Our designs, floor plans, facades, images and inclusions are there to give you a feel for what we build. Please keep the following in mind:

• Images and renders are for illustration only. They may show furniture, landscaping, decor, fittings and finishes that aren't included in a standard price or inclusions list.
• Display homes may include upgrades and items that aren't part of the standard design or inclusions.
• Floor plans, dimensions and areas are approximate and may change through design development, site assessment and approvals.
• Prices, packages and inclusions are a guide only and may change without notice. Prices shown may not include site costs, demolition, permits, authority fees, connections, driveways, fencing or landscaping.
• Promotions are available for a limited time and may be subject to their own terms and conditions.
• Site suitability for any design or knockdown rebuild depends on your block, including its size, slope, soil, easements, covenants, overlays and planning requirements.
• Past projects and testimonials reflect individual clients' experiences and don't guarantee the same outcome for every build.

Your final design, price, inclusions and build timeframe will be set out in your building contract. If anything on the website differs from your contract, your contract applies.

6. Enquiries, consultations and forms

When you make an enquiry, book a consultation or contact us through the website, you agree that the information you give us is accurate and complete.

An enquiry or consultation doesn't commit you or us to entering into a building contract. Any quote, preliminary design or price estimate we provide depends on our assessment of your site and project, and is not binding until it forms part of a signed contract.

7. Intellectual property

All content on the website, including text, photos, videos, home designs, floor plans, facades, logos, graphics and layout, is owned by or licensed to Oak Living. It is protected by Australian and international intellectual property laws.

You may view, download and print content for your own personal, non-commercial use, such as deciding whether to build with us. You must not otherwise copy, reproduce, modify, distribute or publish any content without our written consent.

In particular, our home designs and floor plans must not be copied, adapted or used by any person, builder or designer to build a home. The Oak Living name and logo are our trade marks and must not be used without our permission.

8. Links to other websites

The website may link to or embed content from other websites, such as social media platforms, video hosts, suppliers, finance providers or government bodies. These links are provided for convenience only.

We don't control and aren't responsible for the content, products, services or privacy practices of other websites. A link doesn't mean we endorse the site or its owner. Your use of any other website is at your own risk and subject to its own terms.

9. Privacy and cookies

We collect personal information through the website, for example when you make an enquiry or book a consultation. We handle it in line with our Privacy Policy and applicable privacy laws.

If you give us your contact details, we may contact you about your enquiry. Where you've agreed or the law allows, we may also send you updates about our homes, display homes and offers. You can unsubscribe at any time using the link in our messages or by contacting us.

The website uses cookies and similar technologies to help it work, understand how visitors use it and improve our marketing. You can manage cookies in your browser settings, but some parts of the website may not work properly if you turn them off.

10. Liability

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded.

To the maximum extent permitted by law:

• the website and its content are provided "as is", and we make no warranties about them
• we don't guarantee the website will be uninterrupted, error free, secure or free from viruses
• we aren't liable for any loss or damage, including indirect or consequential loss, arising from your use of or reliance on the website or any linked website

Where our liability can't be excluded but can be limited, it is limited to supplying the relevant services again or paying the cost of having them supplied again.

You agree to indemnify us against any loss, claim or liability we incur because you have breached these terms or misused the website.

Governing law. These terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.
